Ordinance No. 779 series of 2023
AN ORDINANCE CLOSING AND RECLASSIFYING A ROAD LOT DONATED TO THE LOCAL GOVERNMENT UNIT OF TAYTAY, RIZAL TO OPEN SPACE, LOCATED AT SUMMERFIELD VILLAS, BRGY. SAN JUAN, TAYTAY, RIZAL
WHEREAS, in accordance to Presidential Decree No. 1216 there is a need to create and maintain a healthy and suitable environment for citizens to live by providing open spaces, alleys, sidewalks and roads that are convenient to the public and that will enhance the quality of life of the people that dwell therein;
WHEREAS, the Summerfield Villas Homeowners Association Inc. has donated their alleys and road lots located at Summerfield Villas, Barangay San Juan, Taytay, Rizal to the Local Government of Taytay on January 27, 2022 as ratified thru Resolution No. 417 Series of 2022;
WHEREAS, this grant of reclassification was based on the pertinent documents submitted by the applicant and were verified by the Municipal Assessor and Municipal Planning and Development Officer;
WHEREAS, Section 21 of the Local Government Code of 1991 states the regulation on the closure and opening of roads and that in order for roads to be closed an ordinance is necessary;
NOW THEREFORE, BE IT ORDAINED, by the Sangguniang Bayan of Taytay, by the power vested in it by law, in session duly assembled, that:
Section 1. This Ordinance is enacted pursuant to the power vested upon to the Sangguniang Bayan of Taytay, Rizal, by the Local Government Code and other pertinent laws.
Section 2. This Ordinance is enacted relative to properties registered under the name of Summerfield Villas, Barangay San Juan, Taytay, Rizal that need to be reclassified to open spaces.
Section 3. This Ordinance is enacted for the purpose of the following:
a. To guide, control and regulate the future improvement of the said properties. To promote and protect the health, safety, peace, comport, convenience and general welfare of the residents in the nearby are of the location.
b. To regulate the use of machineries and infrastructure that may cause noise and air pollution in the area.
c. Provide an effective requirement to secure necessary license and permit to, operate.
Section 4. This Ordinance is applicable only to TCT No. 700145.
Section 5. That the Road Lot located in Summerfield Villas, Brgy. San Juan, Taytay, Rizal and covered by TCT No. 700145 is hereby Closed and Reclassified as Open Space based on the pertinent documents submitted, provided that the closure and reclassification is subject to any liability if the applicant fails to comply to the requirements of other government agencies concerned or any misrepresentations.
Section 6. Conditions, provisions and guidelines for the improvement and development of the said properties shall be pursuant to existing local rules and regulations, and to the Building Code of the Republic of the Philippines.
Section 7. This Ordinance shall take effect immediately upon its approval.
ENACTED, this 19th day of April, 2023, 3:03 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
