Ordinance No. 773 series of 2023
AN ORDINANCE CREATING TAYTAY GOVERNMENT INFRASTRUCTURE AUDIT TEAM, DEFINING ITS DUTIES AND FUNCTIONS, FUNDING REQUIREMENTS AND FOR OTHER PURPOSES
WHEREAS, extreme events, both natural and man-made, often affect the Philippines. Conscious recognition of this vulnerability brings to fore the key role that local governments must perform in disaster preparedness and mitigation;
WHEREAS, Article II, Section 5 of the 1987 Constitution provides that “[t]he maintenance of peace and order, the protection of life, liberty, and property, and promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy”;
WHEREAS, pursuant to the Republic Act (“R.A.”) No. 10121, otherwise known as the Philippine Disaster Risk Reduction and Management Act of 2010, Local Government Units (“LGUs”) are mandated to ensure the safety and resiliency of communities to face the challenges of disaster;
WHEREAS, Department of Interior and Local Government (“DILG”) Memorandum Circular No. 2011-47, provides that all local chief executives to cause the immediate inspection and assessment of all local government infrastructure projects and building relative to their strength, rigidity, and resistance to wind and seismic loadings;
WHEREAS, pursuant to the Section 524 of R.A. No. 7160 or the Local Government Code of 1991 states that “[e]ach local government unit shall conduct a periodic inventory of infrastructure and other community facilities and undertake the maintenance, repair, improvement, or reconstruction of these facilities”;
WHEREAS, in order to fully comply with applicable laws, to provide utmost Serbisyong May Ngiti to Taytayeños, to ensure the structural integrity of Municipal Government Infrastructure and the safety of the persons inside said infrastructure, there is a need to create the Taytay Municipal Infrastructure Audit Team;
NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan of the Taytay, Rizal, in session duly assembled:
Section 1. Title - This Ordinance shall be known as the “Taytay Government Infrastructure Audit Team (TaGIA Team) Ordinance”.
Section 2. Creation - Taytay Government Infrastructure Audit Team shall be created in the Municipal Government of Taytay to make detailed inventory of Government Infrastructures and Registered Important Cultural Properties to scrutinize the structural integrity and provide a detailed report and recommendation to the Local Chief Executive as to the status of Municipal Government Infrastructure.
Section 3. Composition - The Taytay Government Infrastructure Audit Team shall be composed of the following:
Chairperson: Local Chief Executive
Co-Chairperson: SB Chairperson, Committee on Public Works, Utilities,
and Infrastructure
Members: Municipal Engineer
Municipal Planning and Development Officer
Head, Disaster Risk Reduction and Management Office
Head, Municipal Environment and Natural Resources Office
Head, General Services Office – Inventory
Fire Marshall, Bureau of Fire Protection – Taytay
Representative from the Commission on Audit – Taytay
Ex-Officio Member: Municipal Administrator
Section 4. Duties and Functions - The Team shall perform the following duties and functions:
1. Identify through the use of various hazard maps the vulnerabilities of different infrastructures to various natural hazards such as earthquakes, typhoon, landslides / mudslides / rockslides and flooding;
2. Conduct comprehensive inventories of government infrastructure within the Municipality of Taytay constructed by national, provincial, municipal and even barangays with proper coordination to offices and identify the structures to be audited on a regular basis;
3. Conduct audits quarterly and every after disaster of the identified government infrastructures within the Municipality of Taytay;
4. Submit reports on structural and non-structural defects or signs that should be noted during inspections;
5. Recommended engineering procedures to various types of defects to the offices in charge of repair and maintenance; and
6. Preparation of reports on progress and accomplishments for records and presentation to meetings.
Section 5. Secretariat - The Head of the Disaster Risk Reduction and Management Office shall serve as the Head of Secretariat to be assisted by the Committee of Public Works, Utilities, and Infrastructure. The Secretariat shall provide all the necessary secretariat services to the Team.
Section 6. Meetings - The Team shall meet on a quarterly basis, or as often as necessary.
Section 7. Funding Requirements - Utilization of the Operational Expenses of the Disaster Risk Reduction Management Fund is authorized for the conduct of the regular operations of the Taytay Government Infrastructure Audit Team, infrastructure audit and identification.
Section 8. Separability Clause - In case that any entity, including the Honorable Courts, would rule that specific provisions of this Ordinance are considered null and void for whatever reason, all provisions not ruled as null and void shall remain in full force and effect.
Section 9. Repealing Clause - Any provision of existing ordinance or executive order which are inconsistent with the provisions hereof are hereby repealed, amended or modified accordingly.
Section 10. Effectivity - This Ordinance shall take effect ten (10) days after posting of this ordinance in all official Municipal Transparency Boards.
