Resolution No. 169 series of 2023
A RESOLUTION IN COMPLIANCE WITH THE ORDER OF THE REGIONAL TRIAL COURT, BRANCH 71, ANTIPOLO CITY IN CRIMINAL CASE NO. 16-54205 REGARDING THE MOTION FOR RELEASE ON RECOGNIZANCE
WHEREAS, the Sangguniang Bayan of Taytay received an Order from the Regional Trial Court, Branch 71, Antipolo City from a case docketed as Criminal Case No. 16-54205 entitled: People of the Philippines vs. RITA RIVERA y RIVERA for Violation of Section 11, 2nd paragraph, No. 3, Article II of R.A. 9165;
WHEREAS, the Order requires the Sangguniang Bayan to Comment on the Motion for Release on Recognizance dated February 1, 2023 filed by the accused Rita Rivera y Rivera to the care and custody of Barangay San Juan Councilor Tom Joseph Bermillo y Mendoza;
WHEREAS, Section 6(d) of Republic Act No. 10389 otherwise known as the Recognizance Act of 2012 provides that the sanggunian shall include in its agenda the notice from the court upon receipt and act on the request for comments or opposition to the application within ten (10) days from receipt of the notice. The action of the sanggunian shall be in the form of a resolution, and shall be duly approved by the mayor;
WHEREAS, the Sangguniang Bayan of Taytay, Rizal interposes No Objection to the said motion;
WHEREFORE, it is Resolved by the 12th Sangguniang Bayan of Taytay, Rizal, to adopt this Resolution to COMMENT TO THE MOTION FOR RELEASE ON RECOGNIZANCE FILED BY ACCUSED RITA RIVERA Y RIVERA IN THE ABOVE-ENTITLED CASE AND HEREBY INTERPOSES NO OBJECTION TO THE SAID MOTION.
RESOLVED FURTHER, that the Office of the Mayor be immediately furnished a copy of this Resolution for his approval.
ADOPTED, this 15th day of February 2023, 5:52 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
