Resolution No. 204 series of 2023
A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO ENTER INTO CONTRACT OF USUFRUCT FOR THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, WITH UNIVERSITY OF RIZAL SYSTEM (“URS”) REPRESENTED BY ITS PRESIDENT, NANCY T. PASCUAL, AND FOR OTHER PURPOSES
WHEREAS, Section 1, Article XIV of the 1987 Constitution mandates the State to “protect and promote the right of all citizens to quality education at all levels and shall take appropriate steps to make such education accessible to all”;
WHEREAS, the Municipal Government owns a parcel of land identified as a portion of Cadastral Lot 3119, consisting of Seven Thousand Three Hundred Eighty-Five Square Meters (7,385 sq.m.) more or less, located at Lambak, Brgy. San Juan, Taytay, Rizal and is covered by Tax Declaration No. 18-TY-004-22779;
WHEREAS, the University of Rizal System (“URS”) was previously allocated with the above-mentioned parcel of land under a Tripartite Agreement with Rizal Provincial Government and Municipal Government, through the Donation of one Exequiel D. Robles, President of Sta. Lucia Realty and Development Corporation;
WHEREAS, URS, in order to comply with previous observations given by its accreditors and auditors during program accreditation and International Organization for Standardization (ISO) 9001:2015 Certification, must enter a Contract of Usufruct with the Municipal Government;
WHEREAS, the Municipal Government, with its goal to provide quality education to all Taytayeños, is willing to give the authority to URS to voluntarily and responsibly use, by way of usufruct, the above-mentioned parcel of land, together with all the buildings, and improvements found therein, free from all liens, encumbrances, and charges;
WHEREAS, consistent with the goal of providing Serbisyong May Ngiti to all Taytayeños, the signing of the Contract of Usufruct will strengthen the cause of education for all Taytayeño students;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, to AUTHORIZE THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO ENTER INTO CONTRACT OF USUFRUCT FOR THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, WITH UNIVERSITY OF RIZAL SYSTEM (“URS”) REPRESENTED BY ITS PRESIDENT, NANCY T. PASCUAL, AND FOR OTHER PURPOSES.
RESOLVED FURTHER, that the duly signed Contract of Usufruct with URS shall be ratified first by the Sangguniang Bayan before its full implementation.
RESOLVED FURTHERMORE, that copies of this Resolution be forwarded to the Office of the Municipal Mayor and all concerned for their information and appropriate action.
ADOPTED, this 19th day of April 2023, 3:06 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
